U.S. court blocks Trump ban on transgenders in the military

A federal court on Monday partly blocked President Donald Trump's order that aims to keep transgender persons from joining the US armed forces.

In the opinion, U.S. District Judge Colleen Kollar-Kotelly stated that the government had not proven that national defense was at risk.

President Trump announced in a series of tweets in July that American forces could not afford the "tremendous medical costs and disruption" of transgender troops, and said "the United States Government will not accept or allow transgender individuals to serve in any capacity in the U.S. Military".

While the court issued a preliminary injunction against the actual ban of transgender people, it denied a request in respect to the Sex "Reassignment" Surgery Directive, in which President Trump ordered the Pentagon to hault the funding of gender confirmation surgeries for service members.

Judge Kollar-Kotelly said the plaintiffs were likely to succeed in their claims that the ban was unconstitutional because the reasons given for the ban "do not appear to be supported by any facts".

A study by the Williams Institute at UCLA School of Law found there could be as many as 15,000 transgender people who've served in the military with more than 8,000 on active duty. Under President Barack Obama, that policy was changed to allow transgender service members. He followed with an August memo directing the Pentagon to extend indefinitely a ban on transgender individuals joining the military, and gave Defense Secretary Jim Mattis six months to come up with a policy on "how to address" those who are now serving.

Mr Trump signed a memorandum in August that directed the U.S. military not to accept transgender men and women as recruits and halted the use of government funds for sex-reassignment surgeries for active-duty personnel unless the process is already under way. Therefore, she said, the court does not have jurisdiction to enjoin the aspect of Trump's policy. They highlighted the uncertainty facing Regan Kibby, the transgender Naval Academy student who - because of Trump's action - was unsure whether he would be able to join the Navy on graduation.

Other lawsuits challenging president's directive have been filed in Seattle and Baltimore.

As the news spread on Twitter, transgender people and advocates shared their relief that at least the ban had been blocked.
