O'Reilly, Fox Face Breach of Contract Claims Over Outing of Accuser

Bill O'Reilly Sued by Allegedly Abused Employee You Talked Trash On Me

A woman who settled with Bill O'Reilly is suing the former Fox News star and the cable network that used to employ him for defamation and breach of contract.

A former Fox employee who reached a settlement with Bill O'Reilly in 2002 says he smeared her as a liar, breaking their deal.

.

Now, Rachel Bernstein is taking objection to these comments with a complaint that cites the non-disparagement clause of the settlement agreement she had with O'Reilly in 2002.

In April, the New York Times reported O'Reilly and fox paid out millions of dollars to five women to settle sexual harassment or inappropriate behavior claims. He abused Ms. Bernstein.

Subsequent statements by O'Reilly are alleged to have violated the nondisparagement clause, according to Bernstein. "The case did not involve sexual harassment". Her lawsuit said both O'Reilly and Fox News wrote false statements claiming that no one went to a company hotline to make claims against O'Reilly.

Are we about to see the end of net neutrality?
The FCC's plan to roll back Title II Net Neutrality regulations has been the subject of dire controversy and heated debate lately. One campaign says it has generated more than 750,000 phone calls to legislators.

"He's gone far beyond that and painted our client in a awful light", lawyer Neil Mullin told WaPo, claiming that O'Reilly violated the 2002 settlement case by implying that Bernstein's claims were politically motivated, Variety reported. Bernstein's attorneys also pointed to O'Reilly's response to another Times story published in October, which stated that he paid a $32 million settlement earlier this year to Lis Wiehl, a former legal analyst for Fox News.

That line, and in addition other open proclamations, spoke to a break of his settlement manage Bernstein, she claims in Manhattan Federal Court. "Mr. O'Reilly is fully committed to supporting our efforts to improve the environment for all our employees at Fox News".

"In fact, Ms. Bernstein repeatedly complained to Fox Human Resources, Bill Shine, and other Fox executives, about Mr. O'Reilly's mistreatment and both defendant Fox News Network LLC and O'Reilly knew that before making the statements above", the complaint says.

A Fox News spokesperson and representative for O'Reilly did not respond to a request for comment. The story said Bernstein left Fox "with a payout and bound by a confidentiality agreement", and that her settlement "was far less" than the others.

The plaintiff said she was not the source for the information printed in the Times story.
