Facebook must face class action over face-tagging in photos: judge

The class action will consist of users in IL "for whom Facebook created and stored a face template after June 7, 2011", he said.

A federal judge ruled Monday that Facebook must face a class action lawsuit brought by site users in IL who aren't down with the use of facial recognition technology. Facebook, on the other hand, has been collecting that data including facial recognition for years.

The technology at the heart of all this is Facebook's "tag suggestion" feature, which suggests who may be in a photo based on an existing database of faces. They estimate the case could cover millions of IL residents with Facebook accounts, "many of whom have been tagged in enough photographs to have face templates".

Judge James Donato ruled the claims by IL residents Nimesh Patel, Adam Pezen, and Carlo Licata were "sufficiently cohesive to allow for a fair and efficient resolution on a class basis".

Facebook has stated that they are reviewing the ruling saying, "We continue to believe the case has no merit and will defend ourselves vigorously".

Facebook has said it will comply with law, called the General Data Protection Regulation, and apply it outside Europe, but the company has also faced criticism about whether it gives a real choice to users. The judge also noted that there is enough evidence to suggest that Facebook violated the Illinois Biometric Information Privacy Act (BIPA), enacted in 2008, which forbids companies from profiting from a person's biometric information.

Judge Donato has ruled that the IL privacy act is clear and that Facebook collected a "wealth of data on its users, including self-reported residency and IP addresses". It's the latest privacy controversy for Facebook; last week, CEO Mark Zuckerberg spent two days answering questions on Capitol Hill over the Cambridge Analytica user-data scandal.

Facebook had admitted that almost 5.62 lakh people in India were "potentially affected" by the incident.

Baser said "many" websites and apps use Facebook services to target content and ads, including via the social network's Like and Share buttons, when people use their Facebook account to log into another website or app and Facebook ads and measurement tools.
