73 arrested, charged amid protests at Kavanaugh hearings

Piper Perabo

The third day of Judge Brett Kavanaugh's confirmation hearing for the Supreme Court started with another partisan fight over documents the committee has not publicly released concerning his work at the White House under President George W. Bush.

The tone is different from Kavanaugh's remarks stressing how hard it is to overturn precedent like Roe during confirmation hearings, which opened for a third day Thursday with angry complaints and finger-pointing among senators over the unusual vetting process for the judge.

Kavanaugh will field a second, shorter round of questions from members of the Senate Judiciary Committee on Thursday. One by one, Democrats, including Kamala Harris of California, Cory Booker of New Jersey and Amy Klobuchar of Minnesota, all potential presidential contenders, demanded that Republicans delay the hearing.

"Running for president is no excuse for violating the rules of the Senate", Mr. Cornyn said.

"Count me in", Durbin said. "How many times are you going to tell us this?" he asked. Close to 7% of his documents have been released to the public as part of his nomination process, whilst other nominees - such as Associate Justice Sotomayer - released 100% of their documents during their nomination.

In response to the exchange and the accusations levied against Kavanaugh by Leahy, several progressive watchdog groups-namely Demand Justice, MoveOn, and NARAL Pro-Choice America-jointly called on Senate Democrats to "unilaterally release records that are now in their possession", those marked "committee confidential", that might be able to confirm whether or not Kavanaugh lied under oath.

Republican Senator John Cornyn branded the chaos "mob rule". "I knowingly violated the rules that were put forth", Booker said. Richard Blumenthal, D-Conn. "Just because there's a Senate rule doesn't mean it can be misapplied, misconstrued or misused".

Booker was supported by Democratic Sens.

"If Brett Kavanaugh becomes a Supreme Court justice, will he help gut or overturn Roe v. Wade, which legalized abortion in America?" tweeted Hillary Clinton, the 2016 Democratic presidential candidate.

Kavanaugh has referred to Roe as "settled law" and said that other cases followed the precedent but declined to comment on how he could rule in any future cases.

Woodward book puts White House back in damage-control mode
At one point Mr Kelly, the chief of staff, reportedly said of Mr Trump during a staff meeting: "He's an idiot ". Woodward cites as his sources hundreds of hours of interviews with mostly unnamed Trump aides and others.

"The point there is in the inferior court point", Kavanaugh wrote, responding to a draft op-ed that was circulated for edits between lawmakers and White House staff.

Kavanaugh said that he had not been been aware of the program until it was reported by the New York Times and said that he could not recall if he had ever raised questions about the constitutionality of such a program.

On abortion, Kavanaugh said the landmark 1973 Roe v. Wade decision has been affirmed "many times".

In 2012, Kavanaugh was part of a panel that scrapped an Environmental Protection Agency measure aimed at reducing air pollution in the United States.

"I have ruled sometimes for the prosecution and sometimes for criminal defendants, sometimes for workers and sometimes for businesses, sometimes for environmentalists and sometimes for coal miners".

Pressured by Democrats with Trump on their minds during Wednesday's grueling session, the judge insisted that he fully embraced the importance of judicial independence.

Kavanaugh's seating would cement a conservative majority on the Supreme Court, but it also would give Democrats a rallying cry ahead of the November midterm elections, in which they could seize majority control of the House and possibly the Senate.

Kavanaugh clerked for Kozinski, and Kozinski introduced him during his 2006 confirmation hearing to be a judge.

In the Minnesota Law Review, Kavanaugh argued that while the nation requires a check against "a bad-behaving or law-breaking president", that check is provided only by the US Constitution.
